Message from the NYSTPBA Board of Directors

To all members of the PBA of the New York State Troopers, Inc.,

The NYS Attorney General’s Office of Special Investigation (OSI) has completed its investigation into the unfortunate incident that occurred on November 15, 2023, involving Trooper Adam Latulipe. After a comprehensive review of the evidence, including body-worn camera footage, witness statements, and relevant statutes, OSI has concluded that Trooper Latulipe’s actions were justified under New York law.

As members of law enforcement, we understand the immense pressure and split-second decisions required when faced with a life-threatening situation. On that day, Trooper Latulipe was responding to a call that indicated a potential imminent threat. When confronted by an armed individual who posed an immediate danger, Trooper Latulipe acted in self-defense, as any of us would have under similar circumstances.

The OSI’s report clearly states that a prosecutor would not be able to disprove beyond a reasonable doubt that Trooper Latulipe reasonably believed deadly physical force was necessary to defend himself from what he perceived as an imminent threat. This finding reaffirms the principle that our officers are entitled to protect themselves and others when confronted with deadly force.

We extend our deepest sympathies to all those affected by this tragic event, including the family of the deceased. However, it is crucial to recognize that the OSI’s decision not to pursue charges reflects the integrity and professionalism with which Trooper Latulipe conducted himself in the line of duty.

This outcome should reinforce our collective commitment to upholding the law and protecting our communities while ensuring that our actions are always guided by the principles of justice and fairness.

We stand by Trooper Latulipe and all our members who put their lives on the line every day. Let this serve as a reminder of the challenges we face in law enforcement and the importance of supporting one another as we carry out our duty to serve and protect.
